Ana Kasparian: Fat Clause in Prenuptial Agreements is Okay (Video)

The sacrament of marriage just ain't what it used to be.


Apparently, matrimonial lawyers have been seeing an increase in prenuptial agreements that include this so-called "fat clause." The fat clause essentially dictates that if either spouse (usually the woman) gains too much weight over the course of a marriage then he/she sacrifices certain rights or interests in the event of a divorce.


Wow.


I guess 40 pounds qualifies as an "irreconcilable difference" these days.


Although this practice is decidedly unromantic, it's nothing new. Strange prenuptial clauses have been around since the advent of the prenuptial agreement.


It's important to note that a prenup is not a "divorce contract," as many have wrongfully asserted; it is an agreement between two parties entering into a marriage about how assets will be divided in the event of a divorce.


These fat clauses don't create a weight threshhold that automaticatically triggers a divorce, rather they create penalties for the engorged party if his or her weight gain is the underlying cause of a divorce.
